PRESIDENTIAL PARDON FOR MONTIE 3?
I’ve been following events after the incarceration of the three gentlemen who attempted to rub shoulders with the Supreme Court. It is so unfortunate that the young guys underrated the Supreme Court and thought that the judges are like any other ordinary guys of their calibre.
Now the Supreme Court has ruled on the matter. What I'm surprised about is the fact that some people have been petitioning the President to set the guys free with a presidential pardon.
Let me express my candid opinion on this issue. Have people assessed why presidential pardons are granted? Presidential pardons are granted for common good.... In situations which will bring relieve to criminals who have served some long sentence, have demonstrated reformation or in critical health situations or convicted for capital punishment.
In any of these situations, the president must not be seen as a direct beneficiary of the pardon.
In the case of the Montie 3,
1. Granting pardon will be seen by all as a presidential veto. You see, the case technically is not a crime against the state... It is an insubordination against the Supreme Court. They have directly offended the Supreme Court. Granting a pardon will therefore mean the president supports acts of insubordination against the other arms of government.
2. Granting a presidential pardon will also mean the president is bent on protecting his party men from the grip of laws of the land.
3. Granting presidential pardon will mean the president is being partisan because all those who are calling for it are his party members.
4. Granting presidential pardon will also mean the president lacks sense of judgement because there are more prisoners in our prisons who really qualify for pardon which he hasn't consented to their genuine pleas.
5. Granting presidential pardon will strengthen people with similar tendencies. Similar threats will be heard in most radio stations.
6. Granting presidential pardon may throw the nation into chaos. It will trigger demonstrations and counter demonstrations.
7. Granting pardon in this particular case has the highest potential to create a big constitutional crisis in Ghana. What those who are advocating for the pardon are not very much aware of, is the fact that the Supreme Court can invoke Article 2 of Ghana's Constitution to to set aside the Presidential pardon! 8. Finally, granting such a pardon will subject the nation to international public ridicule and affect the nation's image outside Ghana.
We understand they are speakers for the president's party but I believe nobody from the party asked them to insult and threaten Supreme court judges.
So Mr President, don't listen to anybody to do what is not right. Those calling for the President to do the unthinkable should stop. To the good friends for the Montie 3, the best thing you can do for them now is to visit them in Nsawam Prisons and strengthen them. Take good care of their families and businesses they have left behind. Help the government to improve the quality of life for the prisoners.
But for heaven's sake, stop pestering the president to grant pardon to these friends of yours because their case don’t qualify for it.
